You can’t order lawyer to kneel in court – NBA slams judge

The Nigerian Bar Association (NBA) has strongly condemned the reported actions of a judge at the Federal High Court, Abuja, who allegedly ordered a lawyer to kneel during court proceedings.

The incident, which reportedly occurred on Monday, March 16, 2026, involved Honourable Justice Mohammed Umar and a legal practitioner, Marshall Abubakar, who appeared as lead defence counsel to Omoyele Sowore.

According to reports, the presiding judge directed Abubakar to step out of the Bar and kneel down after the lawyer allegedly raised his voice while addressing the court over the suitability of a hearing date.

The judge was also said to have threatened committal for contempt.

Reacting in a statement, NBA President, Afam Osigwe, described the development as deeply concerning, stressing that such actions undermine the dignity of the legal profession and the sanctity of the courtroom.

“The courtroom is a temple of justice, governed by law, procedure, and decorum,” Osigwe stated, noting that while judges have the authority to maintain order, such powers must be exercised within established legal boundaries.

He emphasised that ordering a legal practitioner, or any individual, to kneel in court is not a recognised judicial sanction under Nigerian law and falls short of expected standards of judicial conduct.

“The power to punish for contempt is well recognised, but it is circumscribed by defined legal procedures designed to ensure fairness and respect for the rights and dignity of all persons,” he added.

The NBA further reiterated that where a judge believes an individual has acted in contempt, due process must be strictly followed rather than resorting to arbitrary directives.

While condemning the judge’s conduct, the association also reminded lawyers of their responsibility to maintain professionalism and decorum in court.

The NBA noted that although legal practitioners are expected to advocate firmly for their clients, such advocacy must remain respectful and within proper legal channels.

The association stressed that the relationship between the Bar and the Bench is built on mutual respect, which is essential for the effective administration of justice.

The incident has since sparked widespread criticism within legal and public circles, with many questioning the propriety of the judge’s actions.

The NBA called for calm and urged that any grievances arising from the incident be addressed through appropriate institutional and disciplinary mechanisms.

It also assured that it would engage relevant authorities where necessary to uphold the rule of law and professional standards.
